Project APX ("we," "us," "our") is operated by Project APX, based in Ontario, Canada. These Terms govern your use of the Project APX website and service (the "Service").
Project APX lets you upload photographs of vehicles and generates new background imagery around them using third-party artificial intelligence services. By using the Service, you acknowledge the output is AI-generated and may not perfectly represent reality.
Access to paid generation is controlled by an access code tied to your purchase. You are responsible for keeping your code confidential. We are not liable for use of your code by anyone you share it with.
You retain ownership of photos you upload. By uploading a photo, you confirm you have the right to use it and to have it processed by our Service and its third-party AI providers. You are solely responsible for ensuring uploaded photos do not infringe anyone's rights or contain unlawful content.
You grant us a limited license to process your uploaded images solely to provide the Service (including sending them to third-party AI providers for processing).
Generation credits are purchased through our payment processor (Stripe). Prices are as displayed at the time of purchase. Credits are non-transferable outside of the account/code they were issued to. See our Refund Policy for details on refunds.
The Service is provided "as is." We do not guarantee that generated images will be accurate, error-free, uninterrupted, or suitable for any particular purpose, including compliance with vehicle advertising regulations in your jurisdiction. You are responsible for reviewing generated images before using them in any listing.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 3 months preceding the claim.
The Service relies on third-party providers (including OpenAI for image generation and Stripe for payment processing). Your use of the Service is also subject to those providers' own terms.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
